Nice home on stilts with 3 bedrooms (1:1 Queen; 2: 1 Queen: 3: 2 Twins and in living room 1 Queen sofa and 1 twin pull out), 2 full baths and one shower (hot & cold) down stairs to wash off all that sand. Soft beachie decor and a fully equipped kitchen. The walk to the beach is 0.6 miles in distance.

RENTAL AGREEMENT

 

My Rental Policy:

 

We abide by the North Carolina Vacation Rental Act.  In compliance with this act and for the benefit of our tenants we include all pertinent information in our Rental Agreement.  We have listed answers to most commonly asked questions below.  Please take the time to read the entire agreement.

 

  • A 100% Deposit is required to secure your reservation.  Your remaining payment is due 30 days prior.

  • A security deposit of $100 will be charged with this rental and due as instructed above.  Not following check out procedures will result in a fee of $25.00 an hour for clean-up.  You must notify owner of any damage or theft to the unit during your occupancy.  The home is carefully inspected after each rental.

  • Combination to keys will be given after final payment and security deposit are paid in full and few days before arrival.

  • Check-In Time is 3:00 PM.  If home is not rented prior, you may come in earlier.

  • Check-Out Time is 11:00 AM.

  • To maintain the high quality of my home, there is NO SMOKING in the HOME.!

  • All Linens and towels for the HOME will be provided.  Not for the beach, bring your own.

  • Please pay careful attention to the Sleeping Capacity listed.

 

Vacation Rental Agreement:

 

This is a Vacation Rental Agreement under the North Carolina Vacation Act. The rights and obligations of the parties to this agreement are defined by law and include unique provisions permitting the disbursement of rent prior to tenancy and expedited eviction of tenants.  Your signature on this agreement, or Payment of money or taking possession of the property after receipt of the agreement, is evidence of your acceptance of the agreement and your intent to use this property for a vacation rental as per agreement.

TERMS:

Diane Clarke (Owner) hereby rent to Tenant, and Tenant hereby rents from Owner the vacation Property described below (referred to hereafter as the “Premises”) on the terms contained in this Agreement.

  1. RENT Payment:

Tenant Agrees to pay rent for the Premises in the amount of $1200.00 in accordance with paragraph 4 below.  Residence is fully furnished incling but not limited to all cooking utensils (pots, pans, dishes, flatware, etc) two changes of linens each for all 4 beds, and plenty of towels (for house use only).  Security deposits are additional and described in paragraph 6 below.  (If paying by check, please send deposits separately as it will facilitate its return to you.  My preferred payment is a Postal Money Order).  Please mail all monies to Attention:  Diane Clarke; 129 Cline Street Concord, NC 28027-4063.

  1. LOST KEYS / LOCK OUT

There will be a $20 charge for any lost key or unreturned key.  Lockout calls to locksmiths and expenses incurred are the Tenant’s Responsibility.

 

  1. SECURITY DEPOSIT

Any security or pet deposit provided for in paragraph 4 above may be applied to actual damages caused by Tenant.  Smoking inside the house is not permitted.  Evidence of smoking inside the house shall result in full loss of security deposit.  Owner shall apply, account for, or refund Tenant’s security deposit within 30 days following the end of the tenancy.  If damages and other unpaid charges should exceed the security deposit, Tenant will be responsible for paying balance to owner immediately.

Please report any damages to the premises IMMEDIATELY upon check-in to Diane Clarke (owner).  Failure to do any of above may result in the damages being applied to the security deposit.  If damages in excess of security deposit must be pursued through an attorney, or if litigation ensues, Tenant will be responsible for attorney’s fees in addition to the other damages recovered by the Owner.

The house is a Smoke-free Environment.  PLEASE DO NOT LEAVE CIGARETTE BUTTS ANYWHERE ON THE PROPERTY.  A $25 Fee will be deducted per hour if found on property.





 

  1. CLEANING FEE

If on Arrival tenant have any housekeeping problems, report this to Diane Clarke immediately.  A one-time end of stay cleaning fee may be charged in addition to the rental fee, per paragraph 4 above.  ALL Cleaning is to be done by Tenant.

Unless discussed prior to renting.   If not cleaned to the conditions you found it in or better, you will be charged for any additional costs due to your stay beyond the security deposit.

There is a washer/dryer and vacuum cleaner on the property for your convenience, as well as a dishwasher inside of the residence. All linens and dishes should be put back in proper place.

 

  1. CANCELLATION

Weekly rentals are not like a hotel, and the Owner does not have the resources to handle late cancellations.  In the event of a written cancellation by Tenant more than thirty (45) days prior to the lease commencement date, Owner will refund one-hundred percent (100%) of any monies paid by Tenant to owner.  Cancellation between fourteen (14) days and thirty (30) days prior to the check-in date will result in a forfeiture of the entire rent as defined above in paragraph 4, unless the property can be released for the entire rental period.  In the case of a cancellation between fourteen (14) days and thirty (30) days prior to the lease commencement date and the Owner is able to rebook the property for the entire rental period defined in paragraph 2, the Owner will refund eighty percent (80%) of the rent as defined above in paragraph 4.  Cancellation within fourteen (14) days of the lease commencement date FOR ANY REASON will result in a forfeiture of the entire deposit and the entire rent as defined in paragraph 4. Additionally, there shall be NO REFUNDs for EARLY TERMINATION for ANY- REASON.

 

  1. MANDATORY EVACUATION:

If State or local authorities ORDER a Mandatory Evacuation of an area that includes the Premises, Tenant shall comply with the Order.  If so ordered, an adjusted refund will be in order after checking with State and Local authorities on the date of said Mandatory Evacuation.  No REFUND of rent will be made in the case of Inclement Weather.

 

  1. INDEMNIFICATION AND HOLD HARMLESS: RIGHT OF ENTRY: ASSIGNMENT

Tenant agrees to indemnify and hold harmless Owner from and against any liability for personal injury or property damage sustained by any person (including Tenant’s guest) as a result of any cause, unless caused by the negligent or willful act of the Owner.  Tenant agrees that the Owner or their respective representatives may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvements thereto as Owner may deem appropriate, or to show the Premises to prospective purchasers or tenants.  Tenant shall not assign this Agreement or sub-let the Premises in whole or in part without written permission of Agent.

 

  1. PETS

Pets shall not be allowed on the Premises without written consent and a non-refundable deposit of $150 for first pet and $50 for second and NO More than two. Tenant’s breach of this provision shall be considered material, and shall result in the termination of the Tenant’s tenancy.  Tenant shall be responsible for the cleanup of any pets on the Premises from the breach and will be billed for such cleanup not done by tenant.  Unless otherwise agreed upon and deposit has been paid. 


 

  1. EVICTION

If you are Evicted from the premises for failure to abide by the rules of the municipality or for any other reason, you will NOT be entitled to a refund of the rents paid in advance and you will be responsible for damages to the property caused by you or your guests.

 

    13) LOSS OR THEFT 

    Owner assumes no responsibility for any loss or theft of Tenant’s personal property. 

 

14)  PHONE SERVICES 

    At present – Non Available. 

     

     15) NO AMENITIES ARE GUARANTEED

      There will be NO REFUND for the malfunction of any equipment including, but     not limited to, air condition, TV, appliances, power outage, and telephone service.  Every effort has been made to ensure all equipment is in working order.  Please     report any inoperative equipment to Owner promptly.  Agent and/or subcontractors may enter premises during reasonable hours to perform maintenance.

   

    16) MAXIMUM OCCUPANCY

    The maximum occupancy of the house is 8 PERSONS and must not be exceeded.  The hosting of parties, which would increase maximum occupancy in the home, on decks or anywhere on the property is a violation of this rental agreement and will result in eviction and forfeiture of all monies paid.

 

    17) TRANSFER OF PREMISES

    Should the Premises be sold or otherwise transferred prior to occupancy, Tenant will be notified of the transfer and of Tenant’s rights concerning refunds or use of     the Premises.

 

    18) CHECK IN & CHECK OUT

 

    Check in time:  3:00 PM – Call to let owner know if anything is wrong when you     arrive.

    Check out time:  11:00 AM – Leave Home clean and Put key back in Security Box.

 

    19) SMOKING

Smoking is not allowed except outside.  If smoking is detected upon inspection,     a $100.00 will be deducted from Tenant’s security deposit to pay for ionization air purification of the home.  If cigarettes or cigars are found around the home, a fee of $25.00/hour will be deducted from the Tenant’s security deposit to pay for removal of such debris.

 

20) HOUSE PARTIES

House parties are strictly Prohibited. Any complaints filed with the police     department against Tenant will result in expedited eviction.






 

21) SIGNATURE TO AGREEMENT

 

Send a Copy of a Valid Driver’s License along with this agreement.  MUST     BE 21 YEARS or older to rent or someone that will be Responsible for the Tenants with a copy of their Driver’s License attached to agreement and an accompanying letter saying they will be responsible.

Wonderful!
We stayed for the week of the fourth with 5 kiddos and there was plenty of room for everyone! The house was lovely and had everything you needed, especially in the kitchen! It was close enough to the beach that we could have walked but didn’t bc we had a toddler. The owner was nice and always answered messages. She made her home feel welcoming! Definitely recommend staying there!
